The man with a defiant gnome in his garden will meet with police today after making an official complaint about the harassment notice he was issued with. Gordan MacKillop, of Treovis, near Liskeard, was woken by police late at night on Wednesday, August 30, to be told his police gnome was 'offensive' to his neighbours and should be removed. 'I was absolutely fuming, I thought they'd been a death in family,' said Mr MacKillop, a marine surveyor at Devonport Dockyard. 'I was issued with a notice at ten to midnight. It is upsetting.' However, a spokesman for Devon and Cornwall police said: 'The notice was served by local officers who determined that the time was appropriate given the priorities on that day.' The harassment notice was issued as the final step in a bid to end an on-running land dispute between Mr MacKillop and his neighbour John McLean. The notice says that the gnome is in an 'annoying place' and accuses Mr MacKillop of intimidating potential buyers of Mr Mclean's £206,000 cottage. It warns the 46-year-old that he could be arrested and prosecuted. 'This is a standard gnome I bought from a retail store. If they are considered to be harassing they should be withdrawn from sale,' said Mr MacKillop. The £13.99 gnome, which is solar powered and dressed in police uniform, is still in its usual place, a stance which may lead to Mr MacKillop being prosecuted under the Protection from Harassment Act 1997, but he isn't concerned. Arrest 'I wouldn't say I'm worried. said Mr MacKillop. 'I will stand up for my rights and if they did arrest me and it went to court I think there would be an outcry. 'I think people are generally fed up with the standard of the police at the moment,' he added. 'I'm not having the police telling me what type of garden gnome I can have in my garden. 'It's all very stupid but the sinister side is that it says on the form should this type of behaviour reoccur I will be liable for arrest and prosecution. 'The gnome is still in the same place. 'I suppose the police could return at any time and arrest him or me.' A spokesman for Liskeard police said they had received the complaint but were unable comment. Mr McLean was unavailable for comment.
