A Government planning inspector has overturned a decision by Caradon District Council to refuse consent for a new home on Bay View Road, Looe. The council's planning committee refused permission to Mr J D Buckland in September last year for the erection of a two-bedroom, split level dwelling on land adjacent to Pine Trees, Bay View Road of its effects on the character and appearance of the surrounding area, on the living conditions of future occupants and on nearby neighbours through overlooking and visual intrusion. Inspector David Wildsmith allowed Mr Buckland's appeal against refusal saying the site could comfortably accommodate a modest dwelling. The design and height of the proposed new home would not be out of keeping with nearby properties and would not harm the appearance of the Area of Great Landscape Value within which the site lies. Thge size of the amenity space proivded would be within Caradon's own guidelines and it would not give rise to 'unacceptable mutualoverlooking' between the new dwelling and nearby properties. Mr Wildsmith said that, in view of the limited size of the site, he agreed with Caradon';s proposal that permitted development rights relating to further development within the curtilege should be removed. He also imposed a condition requiring the council to approve external building materials and proposed boundary treatments.
