A LANDOWNER whose plan for houses in a village was refused earlier this year is taking the case to appeal.

The scheme for 24 houses at Treheath Farm in Dobwalls was refused by a Cornwall Council planning committee by 12 votes to one in September, although the planning officer had recommended it be approved.

Dobwalls and Trewidland Parish Council had objected to the proposal in strong terms, as the site had been marked in the emerging Neighbourhood Plan as unsuitable for development for various reasons. Cornwall Councillor for the area Jane Pascoe said at the time that 250 new houses had been built in Dobwalls in the past five years and that “rapid overdevelopment had put a massive strain on the infrastructure and available services in the village”.

More than 70 local residents who objected at the time were concerned about the already very busy traffic along Duloe Road near the school, as well as the lack of facilities in the village to support more housing.

But now agent T Murphy of Iconic Consultancy has lodged an appeal against the decision to refuse the application. In his letter of appeal he sets out the grounds given by the committee for refusing the application and states the arguments against these reasons.

He argues that the loss of agricultural land would not be significant and that the development would not “harm the natural character and beauty of the area” as the plot is bounded to the north, east and south east by existing development and would be seen in the context of other buildings.

Turning to the second reason for refusal – the lack of a Section 106 agreement for securing planning obligations relating to the site - the applicant states that a Section 106 will be submitted as part of the appeal.

He argues that an additional drop-off and pick-up area for the school will be provided as part of the development and that he has the support of Cornwall’s Affordable Housing team.
